ADMINISTRATION NOTICE ON DATA PROCESSING on the wineglass-communication.hu website

Introduction

This Privacy Notice (hereinafter referred to as the “Notice”) provides information on the processing of personal data relating to the online marketing activities of Wineglass Communication Ltd. (hereinafter referred to as the “Controller”) carried out on https://2020.wineglass-communication.hu/weboldalon (hereinafter referred to as the “Website”), in relation to the specific purposes of the processing, at the same time as the data are collected, in order to comply with the information obligations of the Controller under Article 13 of the GDPR.

This Notice is effective from 22 November 2020 until revoked with respect to the processing of personal data through online marketing activities on or in relation to the Website.

Personal data means any information or piece of information relating to a natural person which makes it possible to identify the data subject (i.e. the data subject), either directly (e.g. by name) or indirectly (e.g. by means of a unique personal identifier). Personal data may include, for example, surname, first name, address, IP address, e-mail address, cookie identifier placed by the browser on Internet devices. 

Persons under the age of 16 may not give their own consent to the processing of their personal data. Therefore, in the case of a minor under the age of 16, we will seek the minor’s personal data and consent to the processing thereof from the legal representative. The consent of the legal representative also implies the assumption of full responsibility for the user activities of the person under the age of 16.  

If you are under the age of 16, please do not independently provide your data on our Website, don’t subscribe to our newsletter or give your consent to the processing of your data. Please ask your parents to read this Privacy Notice and they will give your consent on your behalf and for you to consent to the processing of your data!

Using Google Ads conversion tracking

We use an online advertising platform called “Google Ads” and we use Google’s conversion tracking service as part of this platform. Google Conversion Tracking is an analytics service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). When a user accesses the website through a Google ad, a cookie is placed on their computer for conversion tracking. The validity of these cookies is limited. When the user / website visitor browses certain pages of the Website and the cookie has not expired, Google and the Data Controller may see that the user has clicked on the advertisement. Each Google Ads client receives a different cookie, so they cannot be tracked through the Ads clients’ websites. The information obtained through conversion tracking cookies is used to provide conversion statistics for Ads customers who opt for conversion tracking. Customers are then informed of the number of users who click on their ad and are referred to a page with a conversion tracking tag. If a user does not wish to participate in conversion tracking, they can opt-out by disabling the option to set cookies in their browser. Using Google Analytics

Our websites use Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site you have visited. The information generated by the cookie about the website used by the user is usually transmitted to and stored by Google on servers in the United States. By activating the IP anonymisation on the website, Google will previously shorten the IP address of the user within the Member States of the European Union or in other states party to the Agreement on the European Economic Area. Use of Facebook ads

We use Facebook’s advertising system as Data Controller and within its framework we use the Facebook pixel solution. Facebook Ads is a service of Facebook Inc., 4 Grand Canal Square, Dublin Ireland. When a user/Website visitor visits our Website, a cookie is placed on their computer after consent. The validity of these cookies is limited. When a user browses certain pages of the Website and the cookie has not expired, Facebook and the Data Controller may be able to see which pages the user has visited and which pages the user has viewed. Each visitor receives a different Facebook cookie. The information obtained through the Facebook cookies is used to enable us to serve ads more accurately to our Website visitors and to provide conversion information. If a user / Website visitor does not wish to participate in conversion tracking, they can opt-out by disabling the option to set cookies in their browser. It will then not be included in the visit or conversion tracking statistics. The cookie installed by Facebook pixel also allows us to collect events such as page views from visitors to our website after their explicit consent. The purpose of the processing is to answer the questions asked in the message, to provide the visitors of the Website with the possibility to contact the Data Controller.

Surname and first name, e-mail address, subject of the message, other information provided by the data subject in the “message”, and data generated and provided by the system, such as date and time.

Intended duration of storage of personal data and criteria for determining the duration of storage:
Obligation to erase, withdrawal of consent, but no later than after the contact, upon expiry of the limitation period. Once a year, when the entire correspondence is reviewed, data controllers delete all e-mails where the purpose of the processing has been fulfilled, i.e. when a civil claim can no longer be pursued through the courts.

Purpose of the intended processing of personal data:
The purpose of data processing is to promote, advertise, deliver news, present and advertise the services, products and partner companies of Wineglass Communication Ltd.

Legal basis of data processing:
I ) If you are a natural person who subscribes to our newsletter/eDM newsletter, you give your consent (Article 6(1)(a) GDPR).

You can withdraw your consent at any time by contacting us at the above contact details, which does not affect the lawfulness of our processing before the withdrawal of consent.

A.9. Data processing on social media sites

We use social media sites to keep in touch with people interested in our services, such as Facebook/Instagram social media sites, where we can see the name registered on the social media sites and the public profile picture of the user, if the person concerned has registered on these social media sites and has given permission to the social media site operator in the settings. The processing of data takes place on the social platforms, so the duration of the processing, the way in which the data are processed, and the possibilities for deleting and modifying the data are governed by the rules of the social platform concerned.

We publish our information on our social platforms, such as our Facebook page, Instagram profile, on the interface where the processing takes place and always where the data subjects, i.e. the users of the social platform or profile, provide their data.

On the social platform where the operator of the platform will be a joint controller with Wineglass Communication Ltd, such as our Facebook page, we will also post the essential elements of the joint data management agreement on our social platform, taking into account the rules and possibilities of the platform.

The purposes for which the personal data are intended to be processed:

The purpose of data processing is to promote Wineglass CommunicationKft. services, advertising, news, presentation of its products and partner companies, community building.

Legal basis of data processing:

Data subject’s consent (Article 6(1)(a) GDPR).

Data subject can withdraw his/her consent at any time by un-following the page, by deleting his/her posts. The user can delete his/her own comments at any time. The withdrawal of consent does not affect the lawfulness of our prior processing.

Employees and data processors of the Data Controllers (see: Data Processors) and the operator of the social platform, e.g. Facebook, readers of the social platform’s message boards, news feeds, comments, etc., because users may see each other’s posts and learn different information about each other depending on the social platform’s policies and settings.

Categories of personal data concerned:
We process data that varies from one social platform to another, depending on the structure and data management settings and policies of the social platform, as detailed in our notice on the social platform. In most cases, we will process the name used on the social platform and any data made public by the data subject, such as profile data, comments, so-called likes on posts, etc.

Intended duration of storage of personal data and criteria for determining the duration of storage:
Obligation to erase, withdrawal of consent. Data processing is carried out on social platforms, so the duration of data processing, the method of data processing and the possibility to delete and modify data are governed by the rules of the relevant social platform.

Adequate security

In designing its security systems, the controller has taken into account the state of science and technology, the nature, scope, context and purposes of the processing, and the varying likelihood and severity of the risk to the rights and freedoms of natural persons.

The Controller, together with the server operators, shall ensure the security of the data by technical, organisational and administrative measures that provide a level of protection appropriate to the risks presented by the processing. Data shall be protected against unauthorised access, alteration, disclosure, transmission, disclosure, erasure or destruction and against accidental destruction or accidental damage.

In order to ensure the security of personal data stored on the computers or network of the Data Controller, access to the data is only possible with valid, personal, identifiable access rights, at least with a user name and password, which are regularly changed by the Data Controller.

Data subjects may exercise the following rights throughout the processing:

Access to personal data
The data subject shall have the right to obtain from the Controller feedback as to whether or not his or her personal data are being processed and, if such processing is ongoing, the right to access and request an electronic copy of the personal data.

Right to rectification
The data subject may request the rectification of his or her personal data.

Right to erasure of personal data
The Controller shall erase personal data if the processing is unlawful, the data subject requests it, the processed data is incomplete or inaccurate – and this situation cannot be lawfully remedied – provided that erasure is not excluded by law, the purpose of the processing has ceased or the statutory period for storing the data has expired, or the court or the National Authority for Data Protection and Freedom of Information has ordered it.

Right to restriction of personal data
The data subject may, where appropriate, request the restriction of processing until their request has been assessed.

For example, if he or she objects to processing based on legitimate interests or questions the accuracy of the data processed.

Objection to the processing of personal data
The data subject may object to processing based on legitimate interest. In this case, the processing shall be stopped, except where the processing is justified by compelling legitimate grounds which override the rights of the data subject or where the processing is necessary for the establishment, exercise or defence of legal claims.

Data portability

For processing based on the consent of the data subject or the performance of a contract, the data subject has the right to data portability. On this basis, the data subject has the right to receive personal data relating to him or her which he or she has provided to a controller in a structured, commonly used, machine-readable format and the right to transmit these data to another controller without hindrance from the controller to which he or she has provided the personal data. You may also request the transfer of your personal data to another controller. However, the exercise of this right must not adversely affect the rights and freedoms of others.

Automated decision-making and profiling
The data subject has specific rights in the case of automated decision-making or profiling. The data subject shall have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her.

Procedure of the data controller
The data controller shall inform the data subject of the measures taken or the reasons for non-action without undue delay and at the latest within one month of receipt of the request. If the request is complex, the time limit may be extended by a further two months. Information and action shall be free of charge, except in the case of manifestly unfounded or excessive requests. Copies of the personal data processed will be free of charge in the first case, and a fee equal to our costs will be charged for further copies.
